1. Information Collection Policy
By using the NDA application, you agree to grant us the right to process your personal data for the purpose of providing services available on this application.To enable the application to function properly, we may collect information provided by you, including but not limited to information from your Citizen Identification Card, facial images, and images of your Citizen Identification Card. Algorithms may be used to analyze and process the provided information in order to generate service results and outputs requested by the user.Your personal data will be deleted immediately after the completion of the service.
1.1 Disclosure or Sharing of InformationWe do not disclose or share your data with any third party.
1.2 Information Storage PolicyYour personal data will be deleted immediately after the completion of the service, except for data required for account maintenance and continued use of your account on the application.
1.3 Digital Identity Creation and Management PolicyIdentity Verification Process: Users are required to provide complete and accurate authentication information to create a digital identity. Authentication methods may include OTP codes, multi-factor authentication (2FA), or other security mechanisms.Personal Data Security: We are committed to protecting user information through advanced security technologies such as encryption, blockchain-based authentication, or other secure methods.Identity Management Rights: Users have the right to manage their personal data, including editing, updating, or requesting deletion of their data when necessary.Data Integrity: Digital identity data is protected from unauthorized modification or forgery without user consent through technologies such as digital signatures and decentralized authentication systems.
1.4 Digital Identity Sharing PolicyUser Control: Users have full control over when and with whom their digital identity is shared. Any data sharing requires explicit user consent.Secure Sharing: Data sharing mechanisms must be secured using technologies such as end-to-end encryption and blockchain to prevent unauthorized access or modification.Interaction with Decentralized Systems: When sharing identity information with decentralized systems (e.g., dApps or blockchain platforms), users retain full control over their data, and information is shared only with explicit consent.Data Integrity Maintenance: Any changes or updates to data must be transparently recorded on decentralized systems (e.g., blockchain) to ensure data integrity and verifiability.
1.5 ChildrenWe do not collect or use data from children under the age of 13. If you are a parent or legal guardian and become aware that your child is using the application, please contact us via the email address listed on our website. We will delete your child’s data within 24 hours.
1.6 Information SecurityWe recognize the importance of protecting your personal data and comply with Vietnamese laws regarding physical and electronic data protection measures. While no security system is entirely foolproof, we make every reasonable effort to safeguard your data.All personal data is encrypted during storage and transmission. We employ decentralized authentication mechanisms such as blockchain-based digital signatures or other decentralized protocols to ensure transparency and security.User digital identities are compatible with blockchain systems and decentralized applications, allowing safe usage across platforms.Our systems are protected against common threats such as Distributed Denial-of-Service (DDoS) attacks, spoofing attacks, and other security risks.
1.7 Changes to the TermsThese Terms and Conditions may be updated from time to time to reflect practical needs, legal requirements, or requests from competent authorities. Any changes will be announced on the application or our website. Users are encouraged to review the application and website regularly for the latest updates.
1.8 User ConfirmationBy using this application, you acknowledge and consent to our processing of your data in accordance with these Terms and Conditions.
2. Types of Data Processed and Purposes of Processing Personal Data
The Customer agrees to provide NDA with, and authorizes NDA to process, all personal data that NDA may collect from the Customer or from any information sources (e.g., big data partners or credit information companies), including basic personal data and sensitive personal data as defined under Decree No. 13/2023/ND-CP dated April 17, 2023, of the Government of Vietnam on personal data protection (“Decree 13/2023”) (collectively referred to as “Data”). Such Data shall be processed for the purposes of credit assessment, installment purchase support, contract execution, contract performance, use of contracts as collateral, debt collection (including third-party debt collection), debt sale, customer care, risk management, internal control, reconciliation with third-party service providers, and marketing activities (collectively, the “Purposes”).For the purposes of these Terms, “Data Processing” means one or more operations performed on Data, including collection, recording, analysis, storage, modification, disclosure, access granting, retrieval, recovery, encryption, decryption, copying, transfer, deletion, destruction, or other related actions.
3. Data Sharing with Third Parties and Conditions for Data SharingThe Customer agrees that NDA may share Data internally within NDA, including with owners and current or potential investors, and/or share Data with NDA’s partners (“Third Parties”) for the purposes stated above. NDA shall obtain commitments from such Third Parties to protect Data in accordance with applicable laws.
3.1 Automated Data ProcessingThe Customer agrees that NDA and Third Parties may automatically process Data using software systems and algorithms to make decisions related to Data processing.
3.2 Cross-Border Data TransferThe Customer agrees that NDA may transfer Data outside the territory of Vietnam to Third Parties (if any) for the stated purposes, provided that NDA ensures such Third Parties implement adequate data protection measures in accordance with the law.
3.3 Notification of Data ProcessingThe Customer understands and agrees that Data processing may occur at any time after establishing a relationship with NDA, and that NDA and/or Third Parties are not required to notify the Customer of each instance of Data processing, including automated processing.
3.4 Requests for Data Correction, Deletion, or CessationThe Customer has the right to request NDA to correct, delete, or cease processing personal data in accordance with Decree 13/2023.Within the limits permitted by law, such requests may be made by contacting the Company. The Company will make reasonable efforts to comply with valid and lawful requests within the statutory timeframe, subject to applicable exemptions and fees (if any).If the Customer withdraws consent, requests data deletion, or exercises related rights, the Company may decide to discontinue providing products or services. Such actions may be deemed a unilateral termination by the Customer and may result in contractual breaches. The Company shall not be liable for any resulting losses and reserves all lawful rights and remedies.
4. Rules on Establishment, Amendment, and Supplementation of the General TermsThe Customer acknowledges that these General Terms may be updated and publicly disclosed on NDA from time to time. The Customer is responsible for regularly reviewing updates. Continued interaction with NDA after changes constitutes acceptance of such changes.
4.1 Definitions and Interpretation“Customer Identification Information” refers only to the Customer’s full name, phone number, and email address provided when using NDA services.“Partner” means a third party whose rights and obligations arise directly or indirectly from NDA’s sharing of Customer Identification Information.
4.2 Sharing Information with NDA
4.2.1 Benefits of sharing customer identification information with NDA partners:
  • Receiving promotional vouchers from NDA Partners.
  • Receiving personalized messages and/or calls regarding special offers and invitations.
  • Receiving dedicated customer care services from NDA Partners.
  • And many other exclusive benefits for NDA customers.
4.2.2 By clicking the AGREE button, the Customer consents to NDA sharing Customer Identification Information with its Partners. This consent is irrevocable.
4.2.3 By clicking the AGREE button, the Customer confirms that they have read, understood, and accepted all terms and conditions regarding the sharing of Customer Identification Information with Partners.
4.2.4 By clicking the AGREE button, the Customer waives any right to file complaints, claims, or legal actions related to and/or arising from the Customer’s consent to allow NDA to share the Customer’s identification information with its Partners.
4.3 Information SecurityCustomer Identification Information shared with Partners is protected in accordance with applicable laws.
4.4 Inherent RisksThe Customer acknowledges that transactions conducted over the internet or electronic networks involve inherent risks and voluntarily accepts such risks.
4.5 Governing LawThese Terms and Conditions for sharing Customer Identification Information shall be governed by and construed in accordance with the laws of Vietnam.
